The present petition has been filed by the petitioner, a foreign national (with a foreigner's visa), raising the grievance that he is prevented from travelling abroad due to being involved in criminal proceedings as referred to in the petition. It also transpires that the concerned Trial Court has specifically denied permission to petitioner to travel abroad. 2.

In the above background, the present petition has been filed seeking the following prayers:

"a) Issue an appropriate writ, order or direction in the nature of mandamus directing the respondents to frame an appropriate S.O.P./ Memoranda/Guidelines/Rules to permit the foreigners along with necessary conditions to travel abroad when criminal cases are pending against them; And/Or b) Direct the Respondents to permit the Petitioner to travel to the United States of America for a period of three months to visit his mother and family, subject to such terms and conditions as this Hon'ble Court deems fit, including the furnishing of surety, undertaking to return, and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. disclosure of travel details, etc.; And/Or c) Direct the Respondents to issue specific directions to the respective Consulate to facilitate the travel of the petitioner to the respective country in the light of conditions imposed by this Hon'ble court, if any; And/Or d) Pass such other or further order as this Hon'ble Court may deem fit and proper in the interest of justice."

It is evident that the primary hurdle which coming in the way of the petitioner's travelling abroad is permission of the Trial Court which is seized of the criminal proceedings in which the petitioner is an accused and a chargesheet has also been filed thereof.

Learned CGSC has also emphasised that it is only when the requisite permission is granted by the Trial Court, would the occasion arise to consider the petitioner's request for issuance of appropriate proper travel document/s.

As such, no further orders are required to be passed in the present petition at this stage, except to grant liberty to the petitioner to avail appropriate remedies for the purpose of seeking permission to travel abroad from the concerned Trial Court.
