The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in the nature of Habeas Corpus seeking following reliefs:
(i) Issue a writ of Habeas Corpus or any other appropriate writ/order/direction directing the respondent No.2 and Respondent No.3 to produce the minor girl child before this Hon'ble Court. (ii) Issue a writ of Mandmus by direct appropriate authorities (local police/Delhi Police or child welfare officer) to ensure safe recovery and transfer of the child to the Petitioner's custody at Delhi.

Ms. "S" submits that she is aged about 41 years old and has done her post graduation in Social Work and is currently residing with her minor daughter in Hyderabad. She also submits that she does not want to live with her husband.

In view thereof, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file appropriate petition before the appropriate court/forum seeking custody and other related relief. 5.
Permission and liberty, as prayed for, in accordance with law, is granted.

Accordingly, the present petition is dismissed as withdrawn. 7.
All pending applications, if any, also stand disposed of. 8.
