% 10.02.2017 I.A. 1746/2017 (O 23 R 3) and CS(OS) 1143/2013 Both the parties have moved this application stating that parties have settled their disputes outside the Court and the terms of settlement are recorded in this application. Learned counsel for the plaintiff has submitted that the matter be disposed of in terms of the settlement.
In view of the settlement of the dispute between the parties, terms of which are recorded in the present application, the suit stands disposed of.
Parties shall remain bound by this settlement and the undertaking given by them.
Since the matter stands settled even before the issues could be framed, 50% of the Court fee shall be refunded to the plaintiff in terms of Section 16A of the Court Fee Act read with Section 89 of
