Ms. Archana Sahadeva, enters appearance on behalf of the respondent. Learned counsel says that she has no objection to the appointment of an arbitrator by this court.

Counsel for the petitioner likewise says that the petitioner would have no objection, if this court were to appoint an arbitrator with regard to disputes arising between the parties. 3.

Accordingly, the petition is disposed of on the following agreed terms:- (i) Hon'ble Mr. Justice S.B. Sinha, Former Judge, Supreme Court of India will stand appointed as an arbitrator in the matter. (ii) The arbitration proceedings will be governed by the Rules and Fee Schedule framed by the Delhi International Arbitration Centre (DIAC).

(iii) The Learned Arbitrator shall enter upon reference not before 15.09.2018.

(iv) In the meanwhile, parties and their counsel will appear before the Delhi High Court Mediation & Conciliation Centre (in short 'Centre'). For this purpose, the parties and their counsel will present themselves at the Centre on 26.07.2018 at 3:00 pm. 4.

Needless to say, if the parties reach a settlement via the mediation route, the arbitration proceedings will stand terminated. 5.

In case, settlement is not reached between the parties, as indicated above, the learned Arbitrator will proceed to the adjudicate upon the disputes raised before him.
