This petition has been filed for seeking parole in FIR No. 227/2010 registered at P.S Safdarjung Enclave under Section 302 IPC, which has been rejected by the order dated 21st October 2024, passed by the Competent Authority.

He was granted furlough repeatedly since 2016 all through the years till 2024, the last occasion being in October 2024. There is a note in the Nominal Roll that the wife and the daughter of petitioner had objected to his parole application since petitioner was convicted for the murder of his own son. However, by repeated orders of the Director General (Prisons), he has been granted furlough, as also there is no rejection by the Court on any previous occasion.

Additionally, it is stated in the petition that the aunt of the petitioner is willing to undertake that in case petitioner is released on parole, she shall take responsibility of petitioner. Petitioner had provided an address of A-38, Masoodpur, Delhi-70 where he intends to stay with his aunt. 6.

In view of the above, this Court sees no impediment in granting parole to the petitioner. Petitioner is enlarged on parole for a period of four weeks from the date of release subject to furnishing a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand only) with one surety of the like amount (of the aunt) to the satisfaction of the Jail Superintendent subject to the following conditions:- i.

During the period petitioner remains out on parole, petitioner shall report to the SHO, P.S Safdarjung Enclave Delhi on every Saturday at 4 p.m. and shall not be kept waiting for more than an hour.

Petitioner shall not leave the National Capital Territory of Delhi during the period of parole, without the prior permission of this Court.

Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the complainant/victim or any member of the complainant/victim's family.

v.

Petitioner is directed to surrender before the jail authorities at the expiry of the period of parole.

vi. Petitioner shall not go anywhere near the vicinity of the home or workplace of his wife and daughter or any other member of her family.

Accordingly, the petition is disposed of.

Copy of the order be sent to the Jail Superintendent for information and necessary compliance.
