The petitioner is one of the accused in proceedings instituted by the respondent under Section 138 of the Negotiable Instruments Act, 1881. 2.

Mr. Shaurya Vardhan Kuthiala, learned counsel for the petitioner, states that the proceedings before the learned Magistrate's Court have been dismissed for non-prosecution vide order dated 17.04.2026, as the respondent herein (the complainant before the Magistrate's Court) failed to appear on several occasions.
