By way of present bail application, the applicant seeks regular bail in FIR No. 476/2019 registered under Sections 306/376 IPC at P.S. Tilak Nagar.

A perusal of the records would show that applicant's earlier bail applications came to be dismissed by different Coordinate Benches of this Court. Applicant has earlier approached this Court by way of a revision petition against the charge which came to be dismissed vide order dated 03.04.2024 with the directions to the Trial Court to expedite the trial and make an endeavour to conclude the same within six months. Learned counsel for the applicant submits that the aforesaid directions came to be passed on 03.04.2024 however, trial is still pending. 4.

Ld. APP informs that all the witnesses have been examined and discharged except the IO, who has been summoned for 17.12.2024 for crossexamination. 5.

At this stage, learned counsel for the applicant states that the applicant also wishes to examine witnesses in his defence. He, on instructions, seeks leave to withdraw the present bail application. 6.

Leave, as prayed for, is granted and the bail application is dismissed as withdrawn. However, considering that the applicant is in custody since 2020, the Trial Court shall make an endeavour to conclude the trial within four months from the next date before the Trial Court. 7.

Ld. counsel for the applicant assures that the there would not be any delay in producing the defence witnesses, if any. 8.

Ld. APP for the State also assures that the cross-examination would be done without any delay.
