The present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeks extension of interim bail in FIR No. 305/2023, registered under Sections 186, 353, 323, 489B, 489C, 489D, and 120B IPC at P.S. Special Cell. The petitioner was granted interim bail by the Trial Court on 29th October 2025 for seven days on the ground of his sister's and his own marriage. The Petitioner is now due to surrender on 6th November 2025.

The present application seeks extension of interim bail for certain post-marriage ceremonies such as walima and chaala. The Petitioner has not moved any application before the Trial Court for extension of the said interim bail and has directly approached this Court, apprehending that the Trial Court may not entertain such a request, as it had specifically observed that no further extension of interim bail shall be sought on any ground. Court is, however, not persuaded by this contention since, ordinarily, the Petitioner ought to have first exhausted his remedy by moving an appropriate application before the Trial Court in case of any genuine exigency.

Nevertheless, it is pointed out that the purpose of seeking extension would be defeated, as the Petitioner is due to surrender on 6th November 2025, and tomorrow being a Court holiday, no effective remedy could be availed before the Trial Court. In these exceptional circumstances, the Court has considered the Petitioner's request.

Considering that the factum of the marriages has already been verified, the request is allowed. Accordingly, the interim bail granted by the Trial Court is extended for a further period of seven days from 6th November, 2025, on the same terms and conditions as stipulated in the order dated 29th October, 2025.

With the above directions, the petition is disposed of along with pending application.
