% 02.05.2017 Crl.M.A.7270/2017 Mr.Naman Raj Thakur, learned advocate appearing on behalf of the petitioner, submits that there has been a settlement between the husband and wife. The wife is respondent in the present revision petition. By an order of this Court, the petitioner was directed to deposit 50% of the arrears of the maintenance amount with the Registrar General of this Court. Subject to the payment of the aforesaid amount, this Court had stayed the operation of the impugned order.
The compromise deed between the parties has been made part of the record.
By virtue of the aforesaid settlement the petitioner is required to pay Rs.3 lakhs to the respondent at the time of the first motion before the Family Court, which amount is stated to have been paid. The petitioner is to further
pay an amount of Rs.2.50 lakhs at the time of recording of the second motion. The second motion has not yet been recorded. The respondent is also present in Court. She submits that she does not wish to contest the present revision petition.
As such the prayer made on behalf of the petitioner for withdrawal of the present revision petition is allowed.
The petition is dismissed as withdrawn.
However, the amount which has been deposited by the petitioner before the Registrar General be returned to the respondent on her approaching the Registrar General within a period of 15 days from today. The Registrar General shall take the endorsement of the respondent in token of her having received amount in question.
