The present petition has been filed under Section 484 of the Bharatiya Nyaya Suraksha Sanhita, 2023, seeking grant of interim bail to the petitioner in connection with her custody arising out of FIR no. 79/2023 registered at Police Station Economic Offences Wing under Sections 406/420/120B of the Indian Penal Code, 18601, on the ground of her mother is suffering from Chronic Obstructive Pulmonary Disease (COPD), Coronary Artery Disease (CAD), Diabetes Mellitus (DM), Hypertension, and Tuberculosis, for which the petitioner has been in custody since 16.08.2024 2.

The allegations against the petitioner as per the subject FIR and the Status Report on record are, in a nutshell, that the petitioner is arraigned as a co-accused in a pyramid scheme styled investment fraud where around 69 investors were collectively defrauded to the tune of ₹19.5 Crore, and that 17 more complainants have surfaced after the chargesheet was filed in the matter.

The Status Report on record further states that one Ms. Anita, who in a statement claimed to be a daughter to the petitioner's mother, also states that she has been residing with her tauji since the age of 3 and that the petitioner has been residing with the petitioner's brother for the last 5 years. Ms. Anita also stated that the petitioner's mother had visited Delhi from Dewariya, U.P, for treatment on 8/9.09.2025, and went back to her village on 22.10.2025, where she resides alone and earns her livelihood from farming.

Learned Counsel for the petitioner submits that the petitioner's mother was discharged due to insufficient funds to continue her medical treatment. To buttress his submissions, he relies on a document from Novacare Hospital situated at page 49 of the petition indicating that further treatment of the petitioner's mother is required. 6.
Learned APP for the state submits that, on account of the petitioner's mother living alone for many years as well as the fact that the petitioner's mother may rely upon her son, Satyam, in case the need arises, no ground is made out for the urgent release of the petitioner to care for her mother. 7.

aid to her mother if she were to be released on interim bail, learned counsel for the petitioner candidly admits that there has been no past financial support extended by the petitioner (that she has not held a job for many years prior to the commencement of her custody in the present case) to her ailing mother, and that the petitioner and her mother have not been living together for many years now.

Considering the fact that the petitioner's mother was discharged due to lack of financial support, and that the petitioner does not have a history of providing such financial support or holding a stable job, along with the fact that the petitioner's mother has lived alone at her village for many years now and is responsible for her own income, no ground for urgent release of the petitioner on interim bail has been made out. 9.
