The accused/applicant seeks regular bail in case FIR No. 273/2021of Police Station GTB Enclave for offence under Section 302/307/147/148/149/201/120B/34 IPC and read with Section 25/27 Arms Act.
1.1 This bail application came up for the first hearing on 27.11.2024 before the predecessor bench and thereafter continued getting adjourned before different benches. Along with 179 such old pending bail applications, this application also was transferred to this bench. 1.2 Today is the first effective hearing before me. I have heard learned counsel for accused/applicant as well as learned APP for State. After addressing partly, learned counsel for accused/applicant on instructions seeks permission to withdraw this bail application with liberty to file afresh before the trial court after completion of testimony of eye witnesses namely Sonu, Suresh, Sandeep, Amit and Omwati. 3.
As requested, the bail application and the accompanying applications are dismissed as withdrawn with liberty as sought. Learned trial court is directed to expedite the recording of the testimony of the said eye witnesses.
