The petitioner seeks family pension under the Salary, Allowances and Pension of Members of Parliament Act, 1954, stating that she is the wife of late Mr. Matang Sinh, who served as a Member of Parliament from 1992 to 1998.

The record reveals that the respondent, Rajya Sabha Secretariat, has also received communications from two other persons claiming entitlement to family pension as wives of Late Mr. Matang Sinh. moved an application for impleadment. These facts have been disclosed in the counter affidavit filed by the respondent. Dr. Monika Arora, learned counsel for the petitioner, submits that the petitioner sought impleadment in the said proceedings after filing of the present writ petition.

In view of the fact that the relief sought by the petitioner necessarily involves establishment of her status as the legally wedded wife of her late husband, Dr. Arora seeks permission to withdraw this writ petition with liberty to pursue alternative remedies, including an application for grant of a succession certificate in the petitioner's favour. 4.

In the event such proceedings are decided in the petitioner's favour, the petitioner shall be at liberty to approach the Rajya Sabha Secretariat again with the required documents. 5.

The writ petition is dismissed as withdrawn, with liberty as aforesaid.

All pending applications stand disposed of.
