This hearing has been done through hybrid mode. 2.

The present petition has been filed under Article 226 of the Constitution of India seeking issuance of a writ in the nature of mandamus for refund of the pre-deposit amount of Rs. 5,96,000/- paid by the Petitioner along with interest in terms of Circular No. 984/08/2014-CX dated 16th September, 2014 issued by the Central Board of Excise and Customs. 3.

On the last date of hearing i.e., 27th November, 2024, the Court had issued notice and the same was accepted by the ld. Counsel for the Respondents. Further, time was sought by the ld. Counsel for the Respondents to seek instructions and if necessary, file a counter affidavit. 4.

Today, the ld. Counsel for the Petitioner submits that in this matter, an order has been passed by the Inland Container Depot (ICD), Patparganj, Delhi on 13th December, 2024. A copy of the said order has been handed over today The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and the same is taken on record. The operative portion of the said order read as under:

"I, hereby, sanction an amount of Rs.5,96,000/- (Five Lacs and Ninety-Six Thousand Only) as refund of predeposit along with interest of Rs.2,38,563/-/- (Two Lacs Thirty-Eight Thousand Five Hundred Sixty-Three Only) to M/s Innovative Crafts which will be paid through RTGS."

In view of the above, the ld. Counsel for the Petitioner submits that the present writ is infructuous.

Accordingly, the writ is disposed of as infructuous in view of the order dated 13th December, 2024 passed by the Inland Container Depot (ICD), Patparganj.

The amount which has been sanctioned for refund in the said order of Inland Container Depot (ICD), Patparganj, shall be paid within a period of 8 weeks.
