The instant petition has been filed by the petitioners impugning the order dated 29th January, 2016 whereby the application filed by the petitioners under Order VII Rule 11 CPC has been dismissed by the learned Trial Court.

Mr.B.K.Sood, learned counsel for the petitioners submits that since the civil suit has been withdrawn by the plaintiffs/respondents No.1 and 2 herein, the instant petition has become infructuous. 3.
