% 22.05.2025 CM APPL. 31632/2025[Application seeking direction for the release of the amount] 1.

This Application has been filed in a disposed of matter. The Coordinate Bench of this Court had on 12.12.2024 dismissed the Appeal filed by the Appellant/Insurance Company.

This is an Application filed on behalf of the Respondent Nos. 1 to 5/Applicant inter alia seeking the following prayers: "A. Pass an order directing the Registry of this Hon'ble Court to release the deposited amount along with the up-to-date interest, kept in the form of FDR, in favour of Respondent No. 1"

Issue Notice.

3.1 Learned Counsel appearing on behalf of the Appellant accepts Notice and submits that he does not wish to file Reply and has no objection if the prayer made in the Application is allowed.

Learned Counsel appearing on behalf of the Respondent Nos. 1 to 5 submits that the Respondent No. 1 is the wife of the deceased while the other Respondents are the son, daughter and the parents of the deceased. He further submits that the affidavits by way of no objection of the Respondent Nos. 2 to 5 to release the entire awarded amount in favour of the Respondent No. 1/Claimant, Ms. Sonia Gupta have been placed on record as Annexure A4.

In view of what is stated above, and the affidavits of no objection that have been placed on record, the Application is allowed. 6.

The Impugned Award shall be modified to read that the entire compensation amount be released in favour of the Respondent No. 1 in accordance with the Impugned Award.
