Admittedly, the incarceration period of the applicant, who is a foreign national, is around 21⁄2 years.

There are 21 cited witnesses and out of those, 6 witnesses were dropped in view of the admission of certain documents made by accused and now out of remaining 15 witnesses, 5 witnesses have already been examined. 4.

The quantity of contraband in question is commercial in nature. 5.

During course of the arguments, when asked, Mr. Satish Aggarwala, learned Senior Standing Counsel for DRI submits that every effort would be made to wrap up the trial within a period of six months. 6.

Keeping in mind the abovesaid, this Court is of the view that it may not be very appropriate to go into deeper details qua the issues raised in the present application, at this juncture.

The present application is, accordingly, disposed of with request to prosecution to ensure presence of its remaining witnesses expeditiously so that the trial is wrapped up and case is disposed of within a period of six months.

Learned counsel for the applicant assures that there would not be any delay from their side and they would ensure that any such witness is cross-examined promptly.

In case, for any reason whatsoever, the trial is not disposed of within the abovesaid period, the applicant would be permitted to file application seeking bail before this Court, directly.

The application stands disposed of in aforesaid terms. 11.

All rights and contentions of the parties are reserved. 12.
