Vide order dated 22.08.2025, the Respondent No. 1 was directed to file an affidavit of the Authorized Representative of Respondent No. 1 affirming that Respondent No. 1 has ceased using the mark / label ' '.

The learned Counsel for Respondent No. 1 submits that pursuant to the said order, the Respondent No. 1 has filed an affidavit dated 03.09.2025. However, since the same was under objection, the Respondent No. 1 re-filed the said affidavit on 15.10.2025 vide Diary No. 6374838/2025. The Registry is directed to place the same on record.

He further submits that Respondent No. 1 has no objection if a direction for rectification / cancellation of mark / label 'REEBON / '

Marks is issued by Respondent No. 2.

In view of the above, the present Petition is allowed in terms of prayer Paragraph 31(a) of the present Petition.

The Respondent No. 2 is directed to remove / cancel / expunge the entry pertaining to the impugned registration of Trade mark/label 'REEBON / ' registered under Application No. 4324552 in Class 25 from the Register of Trade Marks. 5.

The Petitioner does not press for costs of the present Petition. 6.

Accordingly, the Petition stands disposed of in the aforesaid terms. TEJAS KARIA, J OCTOBER 16, 2025 'gsr'
