Having been confronted with the fact that the plaintiff no.1 Mr. Gaurav Sapra, made a statement before the Division Bench of this Court in CS (OS) no. 2182/2011, as well as filed an affidavit of undertaking in execution petition No. 121/2015, pursuant to having made the statement before the Court, the same was recorded in judgment dated 15th April 2024, that he had no rights or entitlement on the property bearing No. C-701, Chitrakoot Dham CGHS Plot No. 2, Sector -19, Dwarka, which is the property, for which this instant suit has been filed seeking possession, counsel for plaintiff wishes to withdraw the said suit.

Counsel for plaintiff states that they are the Power of Attorney holders/purchaser who had been given the rights by the said Gaurav Sapra and the suit has been filed in the name of Mr. Gaurav Sapra, through the power of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. In any event, this suit cannot sustain and the suit is, therefore, dismissed as withdrawn. Pending application are rendered infructuous. 4.
Counsel for plaintiff states that they will take instructions to sue Gaurav Sapra, on behalf of the attorney holders.

Needless to state, this Court has not adverted to the merits of the matter and they can pursue their remedies in accordance with law. 6.
