The applicant who is in custody since 02.07.2023 in case FIR No. 477/2023 for offence under Section 394/34 IPC seeks to be released on bail. 2.

The prosecution case is that on 27.06.2023 at about 01:30 pm, a robbery took place in which two boys robbed the complainant de facto of his scooty on pistol point. The boot of the said scooty contained cash amount of Rs. 4,50,000/-. The present applicant was not one of those boys. But according to prosecution, the present applicant was the "Master Mind". 3.

Learned prosecutor on instructions of the Investigating Officer submits that the complainant de facto has already been examined in trial and as is obvious, he did not know the applicant. The only evidence against the applicant according to learned prosecutor is that a sum of Rs. 20,000/- was recovered from his residence and at his instance a country made revolver The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. was recovered. In the process of the alleged recoveries, no public person was joined. That being so, it cannot be apprehended that if released on bail, the applicant would threaten any witness.

In furtherance of last order, status report also was filed reflecting involvement of the applicant in three similar cases, in all of which the applicant is on bail. Besides that, there are two more cases in which the applicant was released by the Court.

Keeping in mind the above circumstances, the application is allowed and the applicant is admitted to bail subject to his furnishing a personal bond in the sum of Rs. 10,000/- with one surety in the like amount to the satisfaction of the trial court.
