The present application under Section 483 of the BNSS (Section 439 of the Cr.P.C.) seeks regular bail in case FIR No. 296/2022, under Sections 302/201/202/212/34 of the IPC and Section 25/27 of the Arms Act, registered at P.S. Gazipur.

Learned Senior Counsel appearing on behalf of the applicant, on instructions, seeks leave to withdraw the present application with liberty to file a fresh application after the examination of PW-1 is complete. It is pointed out that examination of PW-1, who is stated to be an alleged eye-witness, was deferred on account of the ballistic report which has not been filed so far.
