This is a petition filed under Section 439 Cr.PC and 483 of BNSS seeking bail in F.I.R No. 276 of 2016 dated 17.10.2016 registered at Police Station DGG Road, wherein the charges against the petitioner are under Sections 302/201/506/120B of IPC.

Mr. Kumar, learned counsel appearing on behalf of the petitioner states that in the present case, the petitioner is an under trial prisoner and has been in custody for a period of 5 years and 9 months. 3.
However, the learned counsel also conceded that 38 out of 45 witnesses have already been examined and at this stage, directions be issued to the Sessions Court to conclude the trial and dispose of the case at the earliest.

45 witnesses have already been examined, it is expected and hoped that the Sessions Court will conclude the trial and dispose of the matter expeditiously, keeping in mind the principles of Article 21 of the Constitution of India.

In case there is any delay in trial and as and when the prosecution evidence is over, the petitioner will be at liberty to file a fresh bail application.
