This is a petition seeking grant of interim bail for a period of 3 months in FIR No. 965/2022 dated 27.08.2022 registered at PS Nihal Vihar under Sections 302/307 of IPC to enable him to get proper treatment for his illness.

As per the medical report dated 14.10.2024, it was opined that the patient is a known case of Type-2 Diabetes Mellitus/ dyslipedemia/umbilical hernia for which the petitioner/applicant is to undergo surgery. The petitioner was planned for surgery for umbilical hernia at DDU Hospital, Delhi but the same could not be conducted because of his uncontrolled sugar levels.

On 29.10.2024, the medical report of the petitioner/applicant also records the same.

Thereafter, the medical status report has also been received on 07.12.2024, wherein the condition of the petitioner remains the same and his surgery still has not been performed due to uncontrolled blood sugar.

In view of the above, it is apparent that the petitioner is in need of surgery for umbilical hernia but the authorities are not being able to control his blood sugar.

For the said reasons, I am of the view that the petition needs to be allowed. The petitioner is granted interim bail for a period of 4 weeks on the following terms and conditions for getting his surgery done:- (a) The applicant shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Trial Court; (b) The applicant shall provide his mobile number to the concerned IO, which shall be kept in working condition and switched on at all times. In case of change of residential address or contact details, the applicant shall promptly inform the same to the concerned IO as well as to the concerned Court; (c) The applicant shall not leave the country without permission of the concerned Court during the bail period and surrender his passport, if any, at the time of release before the concerned Court;
(d) The applicant shall not directly/indirectly try to get in touch with any prosecution witnesses or tamper with the evidence. (e) Upon expiry of the period of interim bail, the applicant shall surrender before the Jail Superintendent.
