By the present petition, the petitioner seeks first spell of furlough for a period of three weeks in FIR No. 128/2011 registered at Police Station Chitranjan Park, for offences under Sections 302/394/34 of the Indian Penal Code, 1860. 2.

The petitioner is aggrieved that his application seeking furlough has not been decided by the respondent authorities, despite more than two months having been elapsed. 3.

Undisputedly, in terms of Delhi Prisons Rules, 2018, an application seeking parole / furlough is required to be decided within a period of four weeks.

The application seeking furlough was filed by the Pairokar of the petitioner.

It is claimed that the petitioner was not permitted to file the application from inside the Jail, which necessitated his Pairokar to file the same.

Without going into the aspect as to whether any such application was received by the respondent authorities, the present petition is disposed of with direction to the respondent authorities to treat the present petition as an application seeking furlough and pass an appropriate order within a period of three weeks from date.
