The present Petition under Article 227 of the Constitution of India has been filed against the order dated 21.11.2024 passed by the learned Presiding Officer, Motor Accident Claims Tribunal, whereby the Applicant's Application seeking premature release of the FDR, has been dismissed.

The present Application has been filed by Ms. Saloni seeking release of Rs.10,00,000/- for her marriage which is to be solemnized on 02.12.2024.

was awarded on account of demise of Shri Dilip Kumar, father of Ms. Saloni, and her younger brother and their grandfather. Their mother had pre-deceased the father.

It is further submitted that their grandfather has been taking care of the children and in order to meet the expenses of marriage and other miscellaneous expenses of Ms. Saloni, which is on 02.12.2024, premature release of fixed deposits in her name, is sought. 6.

The learned Tribunal vide impugned Order dated 21.11.2024 has observed that such exorbitant expenses of the marriage were not justified and hence, denied release of Rs.10,00,000/-.

The marriage card of Ms. Saloni has been annexed to this Application which shows that she has to get married on 02.12.2024. It is correct that exorbitant marriage expenses are not required to be incurred but definitely certain expenses are required to be incurred on the social function of marriage.

Consequently, considering the background and overall circumstances, Rs.3,00,000/- are directed to be released to the Applicant forthwith.

The Petition is accordingly disposed of.
