File taken up today on office note for dismissal of the Ex. Petition for non-prosecution.

I have examined the office note. It reflects that the suit was filed on 28.05.2013 by the decree holders. Certain objections were raised by the office. The decree holders or the counsel, however, did not appear to remove objections within the prescribed period of 30 days.

In the instant case, the suit is lying under objection since 28.05.2013.

In terms of Rule 5(1) and (2), Part-A(a), Chapter-I, Volume - V, Delhi High Court Rules, Practice and Procedure, objections are required to be removed within 30 days. The objections have not been removed till date.

It appears that the decree holders are not interested in the prosecution of the Ex. Petition. It is dismissed for non-prosecution. S.P.GARG, J.
