Senior Counsel for petitioner points out that an FIR was registered on 4th June 2019, bearing FIR No.100/2019 registered at P.S. EOW under Sections 406/420/120B IPC.

Though petitioner/accused was never arrested, they had undertaken to deposit their passport with the Investigating Agency. Subsequently, since the family of petitioner resides in Canada and he has to visit them frequently, he applied to the Court for release of the passport. 3.
On 30th April, 2022, a closure report was filed by the EOW stating that no charges could be made out against the accused. An order dated 7th June 2022 was passed allowing the release of the passport; however, an undertaking was obtained that the petitioner would not leave the country without the permission of the Trial Court. for permission to travel abroad have been allowed; however, the petitioner was persuaded to deposit the title deeds of a property. 4.
Each time, the petitioner has not misused the liberty granted to him to travel abroad. Two years have passed, and Senior Counsel for the petitioner states that consistent steps to take permission has become onerous for the petitioner. In fact, an application was filed on 15th September, 2023 seeking dilution of this direction for permission to travel abroad and modification of conditions. However, the same has not been decided by the Trial Court. 5.
Senior Counsel for petitioner states that petitioner will undertake to intimate the Trial Court each time he leaves the country. 6.
The Trial Court may decide the said application in accordance with law. The Trial Court may also notify the complainant, who has filed a protest petition, regarding the issue of the said application being listed. 7.
Considering that petitioner has been unable to visit his family on Diwali and Gurupurab and now wishes to go in the first week of December, the Trial Court shall dispose of the application prior to 6th December, 2024. 8.
Accordingly, the petition is disposed of, with the directions to the Trial Court to decide the said application in facts and circumstances as stated therein.
