% 23.08.2017 IA No. 9497/2017 (for disposal of the petition in view of the appointment of the Arbitrator) The present petition is filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of an arbitrator. Learned counsel for the parties have pointed out that the respondent has appointed Sh. D.K. Malhotra, Chief Engineer (Retd.), CPWD as the sole arbitrator to adjudicate all the disputes including the disputes raised by the petitioner.

In view of the above, learned counsel for the petitioner submits that the petition may be disposed of accordingly.

The application is allowed.

ARB.P. 173/2017 In view of the appointment of the Arbitrator by the respondent, the petition stands disposed of.
