CRL.M.C. 1561/2018 1.

Petitioner seeks quashing of FIR No.835/2015 under Section 279/337 IPC, Police Station Sunlight Colony, based on a Settlement. 2.

The subject FIR was registered consequent to an accident, which happened on account of the petitioner driving his vehicle on the

wrong side of the road.

Settlement Agreement dated 10.03.2018 has been entered into between the petitioner as well as the occupants of the vehicle, one of whom who had also sustained minor injuries.

A sum of Rs.50,000/- was agreed to be paid to respondent Nos.2 to 4 as compensation for the injuries sustained. 5.

Respondent No.2 is present in person.

He has filed Special Power of Attorney executed by respondent Nos.3 & 4, who are the sisters of respondent No.2 specifically authorizing respondent No.2 to settle with the petitioner.

Respondent No.2 submits that disputes have been settled and he has received the settlement amount of Rs.50,000/-. 7.

Petitioner is also present in person in Court today. He has regretted his conduct and submits that he shall not repeat his conduct in future.

In view of the above and keeping in view of the fact that the parties have resolved their dispute through a Settlement Agreement dated 10.03.2018, which has been entered into between the petitioner as well as the occupants of the vehicle and the fact that the respondent Nos. 2 to 4 do not wish to press the complaint any further continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the

ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom. 9.

Accordingly, the subject FIR No.835/2015 under Section 279/337 IPC, Police Station Sunlight Colony, as well as the consequent proceedings arising therefrom are quashed, subject to the petitioner depositing costs of Rs.20,000/- with the "Prisoners Welfare Fund, Jail No. 13, Mandoli", Mangal Pandey Marg, Harsh Vihar, Village Mandoli, Delhi, within a period of two weeks from today. Receipt of deposit of the costs imposed by this Order be furnished to the concerned Investigating Officer within a period of three weeks from today.
