Present appeal has been filed challenging the order dated 05th November, 2024 passed by the learned Single Judge in I.A. No. 34501/2024 and I.A. No. 42557/2024 in CS (OS) 2173/2015, whereby the learned Single Judge has issued notice in the application filed on behalf of the respondents/plaintiffs for amendment of the plaint. The appellant further seeks rejection of the plaint in CS (OS) 2173/2015 in terms of Order VII Rule 11(c) of CPC, 1908.

This Court is of the view that the present appeal is premature as the learned Single Judge has only issued notices in the interlocutory applications filed under Order VI Rule XVII and under Order I Rule X CPC. The appellant shall be at liberty to urge all his contentions and submissions before the learned Single Judge once the said applications are taken up for hearing and disposal.
