The Petitioner has been working as Vice Principal in V.S. Agriculture Senior Secondary School ("Respondent School") since 29th November, 2012. He submits that he has been due for promotion with effect from 1st November, 2022 and claims entitlement to appointment against the vacant post of Principal. It is stated that he has already submitted a representation in this regard.

Mr. Sarvesh Singh, counsel for the Petitioner, places reliance on a notification dated 30th November, 2023 issued by the Education Department (Secretariat - Recruitment and Promotion Unit) governing appointments to the post of Principal, to contend that the Petitioner fulfils the prescribed age and other eligibility criteria. Das1, to submit that the right to be considered for promotion has been recognised not merely as a statutory right but also as a facet of a fundamental right.

Having considered the submissions, the Court notes that the post of Principal is a selection post. Such posts are required to be filled through a competitive, merit-based selection process, and are distinct from nonselection posts, which are ordinarily filled on the basis of seniority or length of service. In view thereof, the Petitioner cannot claim any automatic or vested right to appointment to the post of Principal merely on account of eligibility or seniority.

In the opinion of the Court, the right of consideration for a selection post would arise only upon initiation of a selection process. In the absence of any such process having been commenced, no enforceable right accrues in favour of the Petitioner at this stage.

In these circumstances, at the present stage, the Court is not inclined to entertain the present petition. The writ petition, along with the pending application, is accordingly dismissed.
