A Petitioner under Article 226 Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of FIR No.0318/2024 under Section 306/34 registered at Police Station Timarpur. 2.

It is submitted that from the averments contained in the FIR as well as the Status Report it is evident that there are no allegations of abatement of suicide made out against the Petitioner. Moreover, there is a delay of almost one year in the registration of FIR and, therefore, the FIR is liable to be quashed.

Learned APP for State on instructions from the I.O submits that investigations are almost complete and are pending only because one accused namely Gaurav has not joined.

In view of the submissions made, the Petition is disposed of with liberty to the Petitioner to approach after the Final Report is filed, if there is any need.
