Since the petitioner has a vending certificate in the category of "food/snack with gas cylinder/fire", the petitioner, in our opinion, ought not to have been termed/treated as a mobile vendor, as the vending activity with the assistance of gas/fire cannot be mobile.

That being so, we deem it appropriate to permit the petitioner to vend in accordance with law provided that all other conditions are duly complied with by the petitioner.
