% 01.03.2018 After some hearing, the learned counsel for the respondent who is the plaintiff before the trial court in Civil Suit No. TM NO 08/2015 where the impugned order dated 01.02.2016 was passed fairly submitted that the incorporation of preliminary objection as para 3A (a) to (n) as proposed in the application under Order 6 Rule 17 CPC which was dismissed by order dated 01.02.2016 of the Additional District Judge, which only is being pressed now, may be allowed, with all just exceptions.

The petition is, thus, disposed of with directions that the amendments restricted to the above-mentioned paras, by way of preliminary objections (para 3A) shall stand incorporated in the written statement, the remaining proposed amendments to the written

statement not being pressed and having been disallowed. Needless to add, after amended written statement in these terms is submitted, the plaintiff of the case will be entitled to file a fresh replication in answer to the amended written statement. The petition and the application filed therewith are disposed of. R.K.GAUBA, J.
