% 17.05.2017 IA No.5993/2017 moved by the plaintiff under Order 23 Rule 1 of the CPC for withdrawal of suit. It is stated that in Commercial Civil Suit No.48/2016 titled M/s Symphony Limited vs. Groupe SEB India Pvt Ltd & Ors the parties have decided the disputes amicably and had entered into a settlement agreement dated 17.02.2017 - on the basis of which said Commercial Civil Suit No.48/2016 was decreed by the Ahemdabad Court vide order dated 17.02.2017. The copy of said settlement is annexed to the application. These facts are not disputed by the learned counsel for defendants.

In these circumstances, the application is allowed and suit of CS(OS) 1456/2014

plaintiff and pending application are disposed of having been withdrawn in view of the contents of the paragraph No.5 of the settlement agreement dated 17.02.2017. Parties to bear their own costs.
