This is an application filed on behalf of the petitioner Samaludden for the grant of interim bail in case FIR no. 270/2024 under Section 22(C)/25/29 NDPS Act, registered at PS Crime Branch.

The interim bail is being sought on the ground of marriage of the sister of the petitioner, scheduled on 12.11.2025 and the marriage of the brother scheduled for 14.11.2025. It is submitted that the presence of the petitioner in the marriage ceremonies is required for the purpose of performing rituals. He further submits that in the past, petitioner was granted interim bail for a month and he did not misuse the liberty of interim bail. Learned APP under instructions from the Investigating Officer confirms the factum of the marriage of the sister and the brother of the petitioner on 12.11.2025 and 14.11.2025 respectively. Learned APP has also placed on record the copy of the status report, filed before the trial court. It is further submitted that co-accused has been granted interim bail on the similar ground. However, his role is different inasmuch as there is a huge recovery from the possession of the present petitioner. 4.

The status report reveals that the petitioner applied for interim bail in July 2025 on medical grounds using forged documents to avail the bail. The learned trial court while declining the benefit of the interim bail, granted custody parole to the petitioner for attending the marriage functions. 5.

Keeping in view the nature and gravity of offence as also the past conduct of the petitioner in trying to obtain the bail using forged medical documents as also the fact the trial court has already granted custody parole to the petitioner, I do not find any justified reason for the grant of interim bail to the petitioner.

The application is therefore, dismissed.
