This is a petition filed under section 482 read with section 528 of BNSS seeking grant of anticipatory bail to the petitioner in the event of arrest in FIR No.480/2024, dated 31.10.2024, under Sections 304(2)/3(5) of BNS, 2023, registered at Police Station - Geeta Colony. 2.

As per the FIR, 2 persons on a motorcycle snatched the gold chain of the complainant. In the disclosure statement, both the accused persons informed the Investigating Officer (IO) that they had sold the gold chain to the petitioner.

A perusal of the facts as well as the status report shows that the petitioner has only been named in the disclosure statement of both the accused persons and there is no recovery from the petitioner. Further, the petitioner has also joined the investigation and is cooperating with the same. Additionally nothing is to be recovered from the petitioner requiring his custodial interrogation.

For the said reasons, I am inclined to allow the petition and it is directed that in case of arrest in FIR No.480/2024, under Sections 304(2)/3(5) BNS, 2023, registered at Police Station - Geeta Colony, the petitioner shall be released on bail subject to furnishing a personal bond to the tune of Rs. 10,000/- to the satisfaction of the IO. Further, the petitioner shall continue to join the investigation as and when directed by the IO. The petitioner shall also appear before the concerned Court on each and every date of hearing unless exempted by the Court. 5.
