CRL.M.A.14041/2025 (for reduction of number of sureties and surety amount) 3.

This application is filed under Section 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking reduction of number of sureties from two to one and the surety amount from ₹1,00,000/- to ₹50,000/-.

In Re : Policy Strategy for Grant of Bail : 2023 SCC OnLine SC 483, the Hon'ble Apex Court had specifically noted that if the accused is not able to furnish bail bonds and sureties within one month from the grant of bail, the concerned Court may suo moto take up the case and consider whether the conditions of bail require modification / relaxation. It is a common knowledge that the accused persons who are in custody for a long duration of time, oftentimes, find themselves in a position where they are unable to persuade even their family members to stand surety for them. 6.

The applicant is a foreign national and has been in incarceration since 22.01.2022.

For the reasons mentioned in the application, the same is allowed. The order dated 08.04.2025 is modified to the extent that the petitioner is directed to be released on bail (if not in custody in any other case) on furnishing a personal bond for a sum of ₹1,00,000/- with one surety of ₹50,000/-, to the satisfaction of learned Trial Court.

It is made clear that other conditions as imposed by order dated 08.04.2025 shall remain the same.
