The petitioners have filed the present petition, inter alia, impugning the order dated 19.01.2018 passed by the Appellate Tribunal for Forfeited Property rejecting the petitioner's appeal preferred against an order dated 25.09.2017, passed by the seizing authority, on the ground that the said appeal was delayed beyond the period as specified under Section 68-O of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

Admittedly, the said appeal was filed beyond the period of sixty days from the date of the order impugned in that appeal. Although the petitioner had filed an application seeking condonation of delay in filing the said appeal, however, the same was rejected as the Tribunal held that it has no jurisdiction to condone the delay beyond the period of sixty days. 3.

The issue involved in the present case is covered by the decision of this Court in Omax Buildhome Limited v. Union of India and Anr.:

W.P.(C) 1722/2019, decided on 19.02.2019.

In view of the above, the present petition is unmerited and is, accordingly, dismissed.
