The counsel for the plaintiff submits that he wishes to withdraw the present suit with the liberty to file a fresh suit on the same cause of action. 2.

Accordingly, the suit is dismissed as withdrawn with the aforesaid liberty.

In view of the fact that the matter has been withdrawn on the first date itself, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff.
