By way of the present writ petition, the petitioner seeks issuance of writ in the nature of mandamus, directing the learned Trial Court for speedy trail and within a time bound manner in a case arising out of FIR bearing No. 590/2021, registered at Police Station Kanjhawala, for the offences punishable under Sections 307/120-B/34 Indian Penal Code, 1860 (hereafter 'IPC') and Sections 25/27 of the Arms Act, 1959. Issue notice. The learned ASC accepts notice on behalf of the State. 5.

This Court has heard arguments addressed on behalf of the learned counsel appearing for the petitioner as well as the learned ASC for the State and has perused the material available on record, including the Trial Court Record, which has been filed along with the present writ petition. 6.

This Court takes note of the fact that the Prosecution has cited 44 witnesses, out of which only two witnesses have been examined till date. This Court also takes note of the fact that almost on all dates, which have been fixed before the learned Trial Court, the witnesses have either sought exemption from personal appearance or have absented themselves despite service. Further, though the learned Trial Court had issued warrants against the witnesses, the trial has hardly proceeded. The FIR in this case was registered in the year 2021.

Considering the overall facts and circumstances of the case, and the fact that the charge-sheet in this case was filed in the year 2021 and the three accused persons are in judicial custody since then, this Court directs that the trial in this case be expedited and the learned Trial Court will ensure that the trial in this case be concluded preferably within one year, under intimation to this Court.

With these directions, the writ petition stands disposed of. 9.
