It is noted that by the impugned judgment the suit was dismissed but now vide judgment dated 9.7.2018 suit has been decreed.

It is also noted that the defendants/respondents were exparte yet suit was dismissed on account of due filing of the suit not being proved. This aspect has been noted in detail in the order dated 21.3.2018 giving liberty to the appellant to file a review petition. It is this review petition which was allowed and by the judgment dated 9.7.2018 the suit is decreed.

In view of the aforesaid the present appeal is infructuous because now there is a fresh judgment dated 9.7.2018 decreeing the suit.
