% 11.02.2019 In proceedings under Section 138 of Negotiable Instruments Act, 1881 petitioner's application for permanent exemption on medical ground has been rejected by the trial court vide impugned order of 6th December, 2016.
Upon hearing and on perusal of the medical documents, I find that the rejection of petitioner's application is justified. At this stage, learned counsel for petitioner seeks permission to file fresh application for permanent exemption along with latest medical documents. Allowed to do so.
This petition is disposed of, while making it clear that trial court order of 6th December, 2016 will not stand in the way of petitioner before the trial court to consider petitioner's fresh application for permanent exemption.
CRL.M.C. 892/2017
