IA No 5852 /2017 This is an application filed by the applicant Smt. Santosh Grover inter alia praying for impleadment as the legal heir / representative of the deceased plaintiff no.1, Late Sh. Sudershan Grover. It is stated that the deceased plaintiff no.1 is survived by his widow (the applicant), one son and two daughters. It is further stated that the son and the two daughters have executed a Relinquishment Deed in respect of the assets of the deceased plaintiff no.1 in favour of the applicant. The said Relinquishment Deed is also annexed along with the instant application.
The learned counsel for the Defendant has no objection to the present application being allowed. Accordingly, the same is allowed and Smt. Santosh Grover is impleaded as the legal heir/ representative of the deceased plaintiff no.1.
Let an amended memo of parties be filed within a period of one week from today.
The application stands disposed of.
CS(OS) 1508/2012 The learned counsel appearing for the parties state that the parties have settled the matter in terms of the agreement dated 09.11.2016 arrived at before Delhi High Court Mediation Centre (DHMCC). The settlement agreement was also signed by plaintiff no.1, Shri Sudershan Grover, who has since expired. The parties, including Smt. Santosh Grover, widow of plaintiff no.1, are present in the Court today and they confirm the terms of the settlement arrived at between them and undertake to abide by the settlement agreement.
In view of the above, the suit is decreed in terms of the settlement agreement dated 09.11.2016. Let a decree sheet be drawn. The settlement agreement shall form a part of the decree sheet. VIBHU BAKHRU, J MAY 11, 2017 sm
