On the last date, this Court had passed the following order. "There is no compliance of the previous orders. Initially, the present petition was withdrawn and thereafter, a review application has been filed seeking recall/modification. Ld. counsel for the Petitioner submits that his client is willing to deposit the amounts in terms of the Trial Court‟s order. A perusal of the Trial Court‟s order dated 5th June, 2017 shows that a sum of Rs.77,000/- was due and outstanding. In view of the undertaking given by the Petitioner today, it is directed that the sum of Rs.1 lakh shall be deposited with the Registrar General of this Court by way of a demand draft, subject to which, the appointment of Receiver, as per the impugned order, shall remain stayed.

If the amount is not deposited on or before 27th January 2020, the petition shall stand automatically dismissed and the order of the Trial Court shall come into operation. Subject to the said deposit being made, issue notice to the Respondent, returnable on 6th February, 2020."

The Registry has reported that the process fee has not been filed and

even the deposit of Rs.1 lakh, which was directed by this Court, has not been made by the Petitioner.

Accordingly, the petition stands dismissed in terms of the order dated 9th January, 2020. The interim order stands vacated. PRATHIBA M. SINGH, J.
