% 04.01.2017 EX.P. 38/2016 As per office note, the notice issued to judgment debtor by ordinary process and speed post have been received back unexecuted and from the report it appears that judgment debtor is not based at the given address. However learned counsel for decree holder has submitted that since the amount involved in execution petition is less than one crore therefore the same may be transferred to concerned District Court having jurisdiction.

In view of minutes of the meeting of Hon'ble Judges (Original Side) held on 20.10.2016 which has been approved by Hon'ble Chief Justice on 17.11.2016, the pending execution petitions involving a sum upto Rs. 2 crores are to be transferred to concerned District Court.

-2Since sum involved in the present execution petition is Rs.32,56,994/- + Rs. 4136382.38/- (as interest), therefore, the present execution petition is to be transferred to concerned District Court. Accordingly the execution petition stands transferred to the court of learned District & Sessions Judge, Central District (Headquarters), Tis Hazari Courts Delhi for 06.02.2017.

The next date of 09.01.2017 earlier given by the Hon'ble Court, stands cancelled.
