The present petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 (for short „the Act‟) for appointment of an arbitrator. 2.

The brief facts are that the petitioners/ Vinod Bedi & Anr. and the respondents/ M/S Raheja Developers Limited & Anr. entered into an Agreement to Sell dated 13.02.2016 of Apartment No. C-12C4 on 13th Floor, Tower-C in the residential group housing project namely „Raheja‟s Revanta‟, Sector-78, Gurugram, Haryana. Disputes arose between the parties to the lis. The petitioners approached the Haryana Real Estate Regulatory Authority (HRERA), Gurugram and by order dated 05.04.2023, refund of the deposited amount along with interest was directed. The parties subsequently entered into a Settlement Agreement dated 25.02.2025 for amicable resolution of disputes. balance settlement amount. The petitioners on 01.09.2025 issued a notice under Section 21 of the Arbitration and Conciliation Act, 1996 invoking arbitration under Clause 13 of the Settlement Agreement. On failure to do the needful, the present petition was filed.

Learned counsel for the respondent on instructions has no serious objection for referring the matter to arbitration. 4.

The reply is taken on record.

Accordingly, the petition is allowed by appointing Justice Mr. Sanjay Bansal, Advocate. (Mobile No. 9810959432) as the sole arbitrator for adjudication of the disputes which have arisen between the parties. 6.

Arbitral proceedings will be held under the aegis of Delhi International Arbitration Centre (DIAC). Fee of the Arbitrator shall be fixed as per fee schedule.

Before entering upon reference, the learned Arbitrator will comply with Section 12 of the Act.

It is made clear that since this Court has not expressed any opinion on the merits of the rival claims of the parties and it will be open for the parties to file their respective claims/counter claims before the learned Arbitrator which will be considered in accordance with law. 9.

A copy of this order be forwarded to the learned Arbitrator for information.
