Petitioner/plaintiff has assailed judgment and decree dated 28.07.2025 of the learned trial court.

The impugned judgment and decree are clearly amenable to scrutiny under appellate jurisdiction. Learned counsel for petitioner/plaintiff contends that since a statutory provision has been violated in the impugned judgment and decree, the same is assailable under Article 227 of the Constitution of India.

After addressing partly, learned counsel for petitioner/plaintiff seeks permission to withdraw this petition with liberty to raise same grounds as raised in the present petition in fresh appeal or review. 4.

As requested, the petition is dismissed as withdrawn with liberty as sought.
