% 13.07.2017 Petitioner was on bail in FIR No. 39/2012 under Sections 392/397/34 IPC registered at Police Station Roop Nagar. He did not appear before the trial court on 10th November, 2016, 16th November, 2016, 16th December, 2016 and 24th January, 2017; therefore his personal bond/surety bond was cancelled.

Learned counsel for the petitioner submits that petitioner's mother was seriously ill in the months of November/December, 2016, therefore, he could not appear in Court. As regards 24th January, 2017 is concerned, he was arrested in some old case in FIR no. 317/2007 registered at Police Station Roop Nagar and could not appear in Court. Petitioner is in

custody since 15th January, 2017. More than five months have gone by and he has learnt a lesson.

Keeping in mind the totality of circumstances, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
