This petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (erstwhile Section 482 of the Code of Criminal Procedure, 19732) seeks quashing of FIR No. 320/2024 registered under Sections 324(2), 115, 126 of the Bharatiya Nyaya Sanhita, 20233 at P.S. Lajpat Nagar.

It emerges from the record that the parties have an ongoing history of disputes, with each side alleging offences against the other. The Petitioner submits that his complaint was lodged first in point of time and was registered as FIR No. 319/2024 at P.S. Lajpat Nagar. According to him, the present FIR has been instituted thereafter by Respondent No. 2 as a 1 "BNSS"

counterblast to that earlier complaint.

It is evident from the record that both the Petitioner and Respondent No. 2 have been initiating proceedings against each other, giving rise to a pattern of cross-litigation. Court to conclude that it is only Respondent No. 2 who is misusing the process of law or lodging false allegations. If that were so, the Petitioner's own involvement in multiple complaints, as reflected in the tabulation, places him on the same footing.

In these circumstances, this Court does not find any basis to exercise its jurisdiction under Section 528 BNSS.

Accordingly, the present petition is dismissed along with pending application(s), if any.

All rights and contentions of the parties are left open. None of the observations made in the order would not affect the merits of the contention of the Petitioner or that levelled in the FIR.
