On 26.11.2025, we had referred the parties to Conciliation process under the ages of the Delhi High Court Mediation & Conciliation Centre. The Centre has filed a settlement agreement dated 24.12.2025. The same has been signed by both the parties and their counsel. Clauses 3 and 5 of the same read as under:
"3. In view of the present Settlement between the Parties, the entire claim of Second Party company against the First Party stands settled, the appeal bearing RFA (Comm.) no. 622/2025 which is pending before the Hon'ble Delhi High Court is rendered infructuous and shall be withdrawn on or before the next date of hearing i.e., 25.02.2026.
5. That the Appeal preferred by the First Party bearing RFA (Comm.) no. 622/2025, shall be withdrawn by the First Party The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 27/03/2026 at 13:39:47
on next date or any date before the next date of hearing, in view of settlement and satisfaction of claim of Second Party. The Second Party further agree that the final order and decree dated 23.05.2025, passed in the suit bearing CS (Comm.) no. 312/2022 passed by Ld. District Judge (Commercial Court)-02, North District, Rohini Courts, Delhi, stand satisfied." 2.
We take on record the settlement agreement dated 24.12.2025. In view of the fact that the parties have entered into a settlement agreement, and in terms thereof the impugned decree stand satisfied, the learned counsel for the appellants seeks to withdraw the appeal. 3.
The appeal is dismissed as withdrawn.

The pending application is also dismissed as having become infructuous.
